Terms of Service — ClawServe

1. Acceptance of Terms

By accessing or using ClawServe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

ClawServe provides managed cloud hosting for OpenClaw AI assistant instances. The Service includes instance deployment, management, AI model proxy access, multi-channel integrations (Telegram, WhatsApp, Discord, etc.), and related tools and APIs.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Subscription Plans and Billing

ClawServe offers various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to pay the applicable fees. Fees are billed in advance on a monthly or annual basis, depending on your chosen billing cycle. All fees are non-refundable except as expressly stated in our refund policy. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We reserve the right to change our pricing at any time. If we change pricing for your current plan, we will provide at least 30 days notice before the change takes effect.

5. AI Model Proxy Usage

When using the AI Model Proxy feature (pay-as-you-go), you are billed based on token usage. Pricing varies by model and is displayed in the dashboard. Unused balance may be refunded within 7 days of the top-up, provided no credits have been consumed. Once credits have been consumed, the balance is non-refundable. We are not responsible for the content generated by third-party AI models.

6. Refund Policy

We want you to be satisfied with ClawServe. Our refund policy is as follows:

6.1 Subscription Plans

7-Day Money-Back Guarantee: If you are not satisfied with your subscription, you may request a full refund within 7 days of your initial purchase or renewal. Contact support@clawserve.cloud with your account email and reason for the refund.
After 7 Days: Refunds are not available for the current billing period. You may cancel your subscription at any time, and your service will remain active until the end of the current billing cycle.
Annual Plans: Annual subscriptions are eligible for a prorated refund within the first 30 days. After 30 days, no refunds are issued; cancellation will stop the next renewal.

6.2 Pay-As-You-Go Balance (AI Model Proxy)

Balance top-ups are non-refundable once credits have been consumed.
Unused balance may be refunded within 7 days of the top-up, provided no credits have been consumed.

6.3 How to Request a Refund

Send an email to support@clawserve.cloud with the subject line "Refund Request". Include your registered email address, the transaction ID (if available), and the reason for your request. We will process eligible refunds within 5–10 business days. Refunds are issued to the original payment method.

6.4 Exceptions

Accounts terminated for violation of our Acceptable Use Policy are not eligible for refunds.
Promotional or discounted subscriptions may have different refund terms, which will be stated at the time of purchase.
If a user initiates a payment dispute without prior communication, we reserve the right to suspend the account and take further action. We recommend resolving issues through customer support first.

7. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Send spam, phishing, or unsolicited messages through connected channels
Generate, store, or distribute illegal, harmful, or abusive content
Attempt to gain unauthorized access to other users' accounts or data
Interfere with or disrupt the Service or its infrastructure
Resell or redistribute the Service without authorization
Use the Service for cryptocurrency mining or other resource-intensive activities unrelated to AI assistants

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you upload or generate through the Service. We do not access, use, or share your data except as necessary to provide the Service or as required by law.

9. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.

10. Termination

You may terminate your account at any time through the Settings page. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be retained for 30 days before permanent deletion, unless you request immediate deletion.

11. Limitation of Liability

To the maximum extent permitted by law, ClawServe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClawServe operates. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, then binding arbitration if necessary.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
